Adentan High Court Affirms LaNMMA’s Ownership of Madina Zonal Council Office Landmark Ruling

The La Nkwantanang-Madina Municipal Assembly (LaNMMA) has announced that the Adentan High Court has delivered a decisive judgment in its favour in a land dispute with Decorbuild Ltd.

The ruling confirms the Assembly’s rightful ownership and possession of a 4.4-acre parcel of land at the Madina Market, also known as the Madina Zonal Council Office.

According to the Municipal Chief Executive (MCE), Alhaji Ibrahim Fuseini Faila, the court upheld LaNMMA’s lawful ownership and administrative authority over the state land, which is covered by Executive Instrument (E.I. 21).

The court also dismissed all counterclaims filed by Decorbuild Ltd., a decision the MCE says reinforces the Assembly’s mandate to protect public lands for the benefit and development of the municipality.

The Assembly commended the court for its thorough and impartial handling of the case, describing the ruling as a significant step toward preserving lands designated for public purposes—including infrastructure, community facilities, and future municipal planning.

Alhaji Faila expressed appreciation to the Assembly’s legal counsel, Mohammed Awal Alhassan Esq. of Law Premier Consult; Hon. Francis Xavier Sosu, MP for Madina; and the staff of the Assembly for their support throughout the legal process.

As a “dedicated son of Madina,” appointed by His Excellency President John Dramani Mahama, the MCE reaffirmed his commitment to reclaiming state lands that have been unlawfully acquired, encroached upon, or misappropriated.

He stressed that this will be done strictly through lawful, transparent, and accountable procedures. “No individual or group, regardless of status, will be allowed to unlawfully take over government lands,” he said, calling on traditional leaders, Imams, residents, developers, and civil society to support the effort.

The MCE highlighted national efforts under President Mahama’s administration to curb illegal encroachment on state lands. These include:

* A comprehensive audit of state lands allocated between 2017 and 2024, with a mandate to reverse illegal transactions.

* New oversight and transparency measures introduced by the Minister for Local Government, Chieftaincy and Religious Affairs, Hon. Ahmed Ibrahim, such as digitized land records and the requirement for presidential approval for major land transactions.

In alignment with these directives, LaNMMA is intensifying its stance against encroachment on state lands.

The MCE issued a firm warning to all individuals or groups currently occupying, developing, selling, or attempting to take possession of state lands within the municipality to desist immediately.

Drawing on his deep personal knowledge of the area—stemming from his late father’s role as Paramount Chief—he emphasized that the Assembly is fully aware of all state lands within the municipality.

“The Assembly will take all necessary administrative and legal steps, including eviction, demolition, and prosecution, to protect state lands,” he concluded.
