President John Dramani Mahama has assured Chief Justice Gertrude Torkornoo that any petitions seeking her removal will be handled with fairness and strict adherence to due process.
The President expressed this commitment in a letter dated March 28, 2025, underlining the importance of transparency and impartiality in handling such sensitive matters.
The letter, signed by Mr. Callistus Mahama, Secretary to the President, emphasized that Chief Justice Torkornoo would be given a fair opportunity to respond to the allegations against her.
It also stated that she would be fully entitled to a hearing before any action is taken, with the President reiterating his dedication to following proper legal procedures in the handling of the petitions.
“His Excellency wishes to assure you that due process will be followed in handling this matter and that you will be given a full and fair opportunity to be heard,” the letter said.
This assurance follows President Mahama’s decision to forward the three petitions seeking the Chief Justice’s removal to the Council of State for consultation, under Article 146 of the 1992 Constitution.
The petitions, which have raised concerns about the Chief Justice’s conduct, now fall under the Council of State’s jurisdiction.
In response to these petitions, Chief Justice Torkornoo has formally requested copies of the documents to prepare a defense.
Her legal team has asked for seven days to review the petitions and prepare a comprehensive response before any committee of inquiry is formed.
To ensure transparency and fairness, President Mahama has also requested that the Chief Justice submit a preliminary response within ten days of receiving the letter.
This will allow time for further consultations with the Council of State before the next steps are taken.
